Solvish offers registered members a technical platform for setting contentsin accordance with the following provisions.
Solvish provides a technical platform that serves as a socialnetwork for creating and publishing of member profiles and communicatewith others. Users have the ability to post problems that they think areimportant and talk about it with other users in order to ultimately to finda solution for it.
2.1
Prerequisite for the use of the services is to register on www.solvish.com.For registration only corporate entity and natural persons are permitted.Registration is done by entering a valid e-mail address, name, and a profileof a self-selected password.
2.2
If it should be necessary Solvish reserves the right to remove or recover the username of the user for his profile (such as violation of a brand name).
2.3
By registering or just by using our services, you consent to the application of these Terms and Conditions.
2.4
The User shall provide true, accurate, current and complete information as prompted by the registration form and make sure its data in the user account is always up to date.
2.5
After successful registration, the user receives a notification via e-mail confirming the successful registration.
3.1
Solvish distributes and manages all activities of the Solvish network.
3.2
Solvish allows you to use our services in line with the statutory provisions and the provisions of these terms and conditions.
3.3
Solvish does not monitor content that you or other users have saved, posted, or transmitted through our product offering, and is thus not liable for the accuracy, appropriateness, or quality of such content.
3.4
Even though Solvish does not monitor or screen user content, we still reserve the right to reject, block, delete or, if necessary, post to another location within the product offering, any contents accessible through our product offering, especially content that has come to our attention from users who are in breach of these terms of use, without giving reasons and with immediate effect.
3.5
Through the implementation of necessary maintenance and improvements, it may cause briefly, individual malfunctions.
3.6
All functions of Solvish are in the development phase and will be continuously developed. As part of these developments some applications can be improved, modified or expanded. This includes discontinuation of the services in partial or in full.3.7
Solvish provides each user via e-mail informations that are related to changes in the terms and conditions, or changes of the provided services.
4.1
The User warrants that the for registration requested data is correct and complete. If the given data during the registration changes, the user is requested to adapt it in the user profile as soon as possible.
4.2
The user must ensure that he/she uses the account solely by himself/herself and that his/her password in particular is kept secure for this purpose. As the holder of the user account, the user acknowledges that he/she is fully responsible for all activities that transpire through his/her user account. For instance, should the user allow a minor to use his/her account without the permission of the parent or legal guardian, the user therewith acknowledges that he/she is fully responsible for the acts of said user, for monitoring access to the account, for use of the product offering by said user and the consequences resulting from any misuse
4.3
The User agrees to:
(a) ot infringe third party rights (including copyright, trademark, privacy or similar rights) and / or
(b) not violate any other law rules and notices (including antitrust)and
c) not to publish any information that are racist, glorifying violence, pornographic, or harmful to underage.4.4
Solvish offers users the opportunity to upload images and make them available to the public. Solvish itself does not provide this content . Users are therefore responsible for all actions that they perform on their Solvish profile.
4.5
The content published on the profile, as well as the comments are not thoroughly checked by Solvish and do not represent the opinion of Solvish.
5.1
You can delete your account at any time
5.2
If the user didn't activate his account with the activation link within 60 days, the registration will be deleted automatically. A re-registration is possible.
5.3
Solvish can take any measurements if there is sufficient indication that a user has violated statutory provisions, the rights of third parties or the TOS of Solvish.5.4
Any form of malpractive leads to an immediate lockage of the Solvish user profile.
5.5
Additionaly to blocking the user profile, Solvish reserves further legal measurements in case of serious violations.
6.1
Solvish respects the intellectual property of third parties and requests that its users do the same.
6.2
If you believe that your copyrights or other intangible rights, e.g. trademark or personality rights, have been violated by content of another user who uses our product offering to save, post or transmit his/her content, please inform us of this by using the form located on the contact section of our website.
7.1
Solvish is liable in the case of damages to the user (a) arising from death and injury to body and health which are due to a breach of obligation on the part of Solvish, (b) under the provisions of the product liability law, resulting from the acceptance of a guarantee or due to willful deception (c) if Solvish has intentionally caused the damage or caused it due to gross negligence, and/or (d) if the damage resulted from breach of Solvish obligations, fulfillment of which is made possible by proper implementation of the contract and adherence to which the user can at all times rely on and should have full confidence in (cardinal duty).
7.2
Solvish has unrestricted liability as to amount, in cases of Paragraph 1, letters (a), (b) and/or (c). Furthermore, the damage is limited to foreseeabledamage typical to the contract.
7.3
In all cases other than the ones mentioned in Paragraph 1, the liability of Solvish is excluded regardless of legal reason.
7.4
The liability regulations in the previous paragraphs also apply to personal liability of agents, employees and vicarious agents of missing link - Web Development UG (haftungsbeschränkt).
The user indemnifies Solvish and its affiliates upon first request from all claims that third parties make towards Pinspire GmbH claiming that content placed on the website by the user does injury to them with respect to their rights or constitutes a breach of legal regulations; included herein are the costs associated with a legal defense. The same applies to claims that are asserted on the basis of violation of the terms of use.
9. Changes of terms of useSolvish reserves the right to change these terms of use with future effect. In such a case, Solvish will inform you in advance about the changes to these terms of use and will advise you that the changes will be considered to be in effect if you do not appeal the changes within a period of six weeks.
10. Trademarks and other industrial property rights of SolvishYou acknowledge that all rights to the product offering of Solvish and its identification symbol including any trademark, patent, copyright or licensing rights or other rights or comparable legal positions in relationship to you, are the exclusive property of Solvish and that you will not make use of them or remove evidence of the proprietorship of Solvish without express, prior written consent from Solvish. The above clause does not apply to content of your own that you place in our product offering and for similar content of other users. In this respect, however, you must respect the rights of the other parties entitled to that content.
11. RevocationEach user can cancel the contract within 14 days without giving reasons in textual form (letter, fax or e-mail).The time limit begins after receipt of this notice in written form, but not beforethe contract is concluded and also not before fulfillment of the obligations under Article 246 § 2 in connection with § 1 Sections 1 and 2 EGBGB. 12. Donations12.1
Certain non-profit associations, recognized under German tax law as a charity (charity), can be offered the possibility to collect donations on the Solvish platform. It is absolutely free to choose if the user wants to donate or how much he/she wants to donate. Donations are collected via "Sofortüberweisungen". More information about the system can be found at www.sofortüberweisungen.de.
12.2
Solvish provides only the technical infrastructure, on which the supporters and beneficiaries come together.
12.3
It is only possible to donate directly to the charitable organization. Donations to Solvish are not possible.
12.4
All useful information on these projects can be found on the Solvish platform itself.For further informations on the project and those involved, visit the homepage of the beneficiaries . It is the responsibility of every supporter to obtain all the information he needs for his decision to grant a donation to a specific fundraising goal.Solvish do not check the set projects, in particular, neither the presentation of the project nor the project reports.Solvish do however check the organizations that are recognized under German tax law as a charitable organization by presenting a current valid exemption certificate.
12.5
If the problem was, as stated in the project solved, then the beneficiary has to solved mark the project as solved and promptly disclose it at Solvish.
12.6
The donation process at Solvish is safe . The data are transfered over an encrypted connection (SSL) and only used in the context with the donation. Without the consent of the donor, the data is not passed to third parties.
13.1
These terms of use are governed by German law. Place of jurisdiction is as appointed in Hamburg (Germany).
13.2
If any provision of these Terms are in whole or partial invalid, the validity of the remaining provisions are not affected.
